Golden Township Itinerant Merchants Ordinance

Ordinance No. Four

Section I

License required. It shall be unlawful to do business in the Township as an itinerant merchant without having first secured a license therefor as is herein provided. For the purpose of this Ordinance, any merchant engaging or intending to engage in business as a merchant in the Township for a period of time not exceeding sixty (60) days shall be considered as an itinerant merchant, provided that door-to-door peddlers shall not be considered itinerant merchants.

Section II

Applications. Every application for such a license shall set forth the name, address and sales tax number of the applicant, the commodities to be sold and the place intended to be occupied or used for business. Application shall be filed with the Township supervisor who may issue a license if the applicant complies with this ordinance.

Section III

Fees. The fees for such licensees shall be $100.00 for one month and $5.00 for one day.

Section IV

Licensed premises requirements. Any premises to be licensed for itinerant merchants shall meet the following requirements:

A. Show ownership of the property or a written lease from the owner of the property and an attorney’s title opinion certifying such ownership.

B. Be conducted more than twenty (20) feet from the edge of the road right-of-way.

C. Provide motor vehicle off-street parking for not less than five (5) motor vehicles.

D. Confine operations between the hours of 6:00 a.m. and 9:30 p.m. daily.

E. Provide sanitary facilities for licensee and any employees approved by the 5th District Health Department.

F. Provide evidence of a valid sales tax license.

Section V

The Township supervisor may revoke the license upon finding that the applicant has made false statements to secure a license or has failed to comply with the terms and conditions of the license or this Ordinance.

Section VI

Penalty. A violation of this Ordinance shall be a misdemeanor punishable by a fine of not to exceed a $500.00 fine or imprisonment in the County Jail for not to exceed Ninety (90) days or both such fine and imprisonment.

Effective Date.

This Ordinance shall be effective immediately upon the publication thereof.
