Golden Township Amendment to

Noise & Public Nuisance Ordinance

Ordinance No. Eighteen

 

An ordinance amending Golden Township Ordinance No. 6, the Township anti-noise and public nuisance ordinance.

 

The Township of Golden, Oceana County, Michigan, ordains:

 

Section I. 

Section III., Sub-Section A, of Golden Township Ordinance No. 6 is hereby amended to read as follows:

 

A.  General regulation.  No person, firm or corporation shall cause or create any unreasonable or unnecessarily loud noise or disturbance, injurious to the health, peace or quiet of the residents and property owners of the Township.  No person, firm or corporation shall permit, continue or permit the disturbance, injurious to the health, peace or quiet of the residents and property owners of the Township.  The owner, lessee or occupant of the property on which is located the activity which constitutes a violation of this ordinance, shall be deemed responsible for the violation.

 

Section II.

Section III., Sub-Section B., Paragraph 13 of Golden Township Ordinance No. 6 is hereby amended to read as follows:

 

The operation of any race track, proving ground, testing area, obstacle course, or the operation of any area used in whole or in part for the racing, scrambling or other similar operation, for motor vehicles, motorcycles, boats, racers, automobiles or vehicles of any kind or nature in any area of the Township where the noise emanating therefrom would be unreasonably disturbing and upsetting to other persons in the vicinity.  Under no circumstances shall and racetrack, proving ground, testing area, obstacle course or any area used in whole in part for the racing, scrambling or other similar operation, fro motor vehicles, motorcycles, boats, racers, automobiles or vehicles of any kind or nature, operate after 11:00 p.m. on any evening.

 

Section III.

Section V. of Golden Township Ordinance No. 6 is hereby amended to read as follows:

 

No person, firm or corporation shall create, cause, maintain, permit, continue or permit the continuance of any public nuisance within the Township by the unreasonable emission of dust, smoke, fly ash, noxious odors, or loud noise or disturbance which are offensive or disturbing to adjacent property owners and residents or persons in the area.  Any violation of this ordinance shall constitute a public nuisance.

 

 

 

 

 

 

 

 

 

 

Section IV.

Section VII of Golden Township Ordinance No. 6 is hereby amended to read as follows:

 

Penalties:  Any person, firm or corporation, and any officer of a corporation found violating the provisions of this ordinance, shall upon conviction, be punished by a fine of not to exceed $500.00 or by imprisonment not to exceed 90 days, or by both such fine and imprisonment, at the discretion o the court.  Each day that a violation shall continue is to constitute a separated offense.  Provisions of this Ordinance may also be enforced by suit for injunction, damages or other appropriate legal action which may be brought by any injured person, firm or corporation, or by Golden Township through its Board of Trustees.

 

Section V.

Validity:  The several provisions of this ordinance are declared to be separate; if any court of law shall hold that any section or  provision thereof is invalid, such holding shall not effect or impair the validity of any other section or provision of this Ordinance.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Effective Date.

This Ordinance shall be effective 30 days after the publication thereof.
